Welcome to DOST Technology Hub. The following TERMS AND CONDITIONS shall govern your access and use of the services in the DOST Technology Hub Website. By accessing and/or registering to the DOST Technology Hub, you acknowledge that you have read, fully understood, and agree to be governed by the TERMS AND CONDITIONS provided herein. If you do not agree on any terms provided herein, kindly do not/discontinue your access or use of the DOST Technology Hub Website. Kindly frequently review this page to verify familiarity with the current version of the Terms. These Terms shall be effective, valid, and binding from the time of your agreement which is from the time of your registration or using of DOST Technology Hub. All such guidelines or regulations are hereby made a part of this Agreement by reference.
PLEASE READ THESE TERMS AND CONDITIONS (“TERMS” or "AGREEMENT") IN ITS ENTIRETY BEFORE YOU BEGIN OR CONTINUE TO USE/DOWNLOAD ANY CONTENT FROM THE WEBSITE AS THESE TERMS CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND DOST TECHNOLOGY HUB.
1. Use and Acceptance of the Terms
1.1 The TERMS set forth in this document, as well as the Privacy Policy, govern your access to and use of the services, software, and technology transfer products made available through the DOST Technology Hub Website (“Site”), the rules and policies of the Site that DOST Technology Hub may publish from time to time. The TERMS refer to both this document and any other Site rules and policies collectively.
1.2 By using the Site and/or registering, you affirm, guarantee, and agree that you are of legal age to do so and to subject yourself to any liability you may incur as a result of doing so. You acknowledge that it is solely your responsibility to utilize the Site (as well as for use of your User Account by others, including your colleague). You agree to monitor any site use made by your coworker using your name or account.
You must be at least eighteen (18) years old to register as a user. By registering, you affirm that you are at least eighteen (18) years old, have the mental capacity to accept these Terms, and agree to: (a) fully and truthfully complete the registration form on the website (this information is referred to as the "Registration Data"), and (b) To maintain the Registration Information accurate, current, and comprehensive, please update it right away.
1.3 This Agreement may be modified by DOST Technology Hub at any time and with immediate effect by posting a notice on the Site. If you use the Site after getting such notice, we'll consider that you've agreed to this Agreement in full, including any changes we make as provided in the notice. If at any time you feel that the terms and conditions of this Agreement are no longer acceptable to you, you must immediately discontinue using the Site.
DOST Technology Hub reserves the right to change these terms at any moment and without previous notification. Any amendments to these conditions shall be effective immediately upon posting on this website, with an updated effective date. You acknowledge that you have read and agree to the Terms on a prospective basis following the effective date of any amendments to these Terms by accessing or using the DOST Technology Hub Services.
1.4 The Terms may not otherwise be modified except in writing by an authorized officer of DOST Technology Hub.
1.5 You acknowledge that while using the Site, you may learn Confidential information about us or another user. You also agree that, except as expressly permitted by this Agreement or as required by applicable law, you will not use or disclose any such Confidential Information during the term of this Agreement or in the future without the express written consent of DOST Technology Hub.
2. Services Provision
2.1 In order to access and use the services in the Site, the User has to register first through www.techub.dost.gov.ph. Unregistered Users shall only have limited access to the Site. The DOST Technology Hub retains the right to impose additional terms, in our discretion, may restrict User access to or use of particular Services (or any features within the Services) without prior notice.
2.2 Services (or any features within the Services) may change depending on the site's User. There is no guarantee or representation that a certain Service, its feature or function, or the same kind and scope of the Service, its feature and function, will be accessible to Users. At its sole discretion, DOST Technology Hub may restrict, refuse, or provide different levels of access to and use of any Services (or any features within the Services) to certain Users.
2.3 The DOST Technology Hub maintains the right, at any time and for any reason, to review, monitor, block, modify, remove, deactivate access to, or otherwise make any User Content (including without limitation your User Content) inaccessible. If at any time DOST Technology Hub chooses, in its sole discretion, to monitor the Service, DOST Technology Hub nonetheless accepts no responsibility for User Content and assumes no obligation to delete or remove any incorrect User Content. We reserve the right to edit, refuse to post, or remove any User Content at our sole discretion, but we are not obligated to do so.
2.4 Some Services (or part thereof) may be provided by DOST Technology Hub’s affiliates on behalf of DOST Agencies and Regional offices.
2.5 DOST Technology Hub's search results and rankings are based on a number of different systems for classifying and ordering search results for your convenience. Some of these rankings are generated by a fully automated ranking system (algorithm) and are based on a variety of variables. We neither guarantee nor represent the accuracy of these results or rankings.
3. Users Generally
3.1 You acknowledge that using or accessing the Site or Services constitutes your acceptance of this agreement and that you will abide by all applicable laws and regulations.
3.2 You also agree not to use the Site in any way that could damage the Site or interfere with the use of the Site. Furthermore, you agree not to try to use the networks, computers, or other User’s accounts of the DOST Technology Hub in any illegal way. Additionally, you agree not to try to access any materials or information through any routes that the Site has not explicitly made available or supported.
3.3 You acknowledge and agree that (a) you will not duplicate, download, publish, sell, distribute, or resell any Services or any text, photos, graphics, audio clips, video clips, databases, listings, or other materials found on or through the Site, and (b) You won't utilize any of the site content in any way to operate a business that is in direct competition with DOST Technology Hub or for any other type of commercial exploitation. DOST Technology Hub forbids the use of any information or materials on the Site for any purpose that is not expressly authorized by the Terms.
DOST Technology Hub is not responsible for the information contained in any such communications or content since it is unable to and does not monitor all messages or content that is published to the website. Despite the aforementioned, DOST Technology Hub reserves the right to delete, move, or modify any message or Content that, in DOST Technology Hub's sole discretion, violates or may violate this Agreement or is otherwise inappropriate. You will continue to be solely responsible for any interactions you have or Material you publish using your account. The DOST Technology Hub reserves the right—but not the obligation—to correct any errors or omissions in any Material that it considers necessary in its sole discretion. You acknowledge that any screening of content that DOST Technology Hub performs to determine Approved Content is done completely out of consideration for others.

3.5 The DOST Technology Hub may provide users with access to third-party websites' content and services via links, APIs, or other means. We do not have any control over, responsibility for, or sponsorship over anything on a Third Party Site. Our responsibility policy excludes any losses or claims you may have against a Third Party Site.
3.6 You consent to refrain from acting in any way that could compromise the security or confidentiality of the computer systems or networks used by the DOST Technology Hub, another User, or both, or that could allow unauthorized access to them.
4. User Accounts
4.1 In order to access or utilize certain Services, User must first register with the Site (a registered User is also referred to as a "User" ). One User may only register one user account on the Site, unless with DOST Technology Hub's consent. The DOST Technology Hub reserves the right to immediately suspend or terminate your account for anything we believe violates this Agreement or for inactivity.
4.2 Upon registration on the Site, each user who registers on the site will receive an account, a User ID, and a password from DOST Technology Hub. An account may contain an email address that can be used to send and receive emails.
4.3 A set of User ID and password is unique to a single account. Each User is solely responsible for protecting the privacy and security of their User ID and password. Users are restricted from sharing their account information with third parties, allowing unauthorized access to their accounts, or taking any other actions that might harm the security of their accounts. You are entirely in charge of protecting the privacy of the login information, as well as any and all uses that may be made of it. Everything that occurs through your account is under your control. In the event you are aware of or reasonably suspected of a security breach or unauthorized disclosure of your Login Information, you need to immediately notify the DOST Technology Hub and change your Login Information.
4.4 Users agree that all use of the Site and Services, and all activities (including without limitation, posting any image, clicking to accept any Additional Agreements or rules, adopting technologies, sending and receiving emails) that occur under your account will be considered authorized by the User.
4.5 Users acknowledge that sharing your account with other people, or allowing many to use your account may cause irreparable damage to the DOST Technology Hub or other Site Users. Additionally, User acknowledges that DOST Technology Hub shall not be liable for any loss or damages resulting from User's multiple account usage or User's failure to maintain the security of User's account and shall have the right to suspend or terminate User's account without liability to User.
5. User’s Responsibilities
5.1 Each User guarantees, represents, and acknowledges that (a) they have the legal capacity and authority to accept the Terms, grant the license, and carry out their duties hereunder, and (b) their use of the Site and the Service shall be for technology transfer purposes only.
5.2 As part of the registration process on the Site for your access to and use of any Service or the User account, Users will be required to complete the registration form and provide information or material about your entity. Each User represents, warrants, and agrees that (a) all information and material provided by such User, whether provided during the registration process or subsequently throughout the use of the Site or Service, is true, accurate, current, and complete, and (b) you will maintain and promptly amend all information and material to keep it true, accurate, current, and complete.
5.3 As a Registered User, you agree that your contact information will be added to our database and give DOST Technology Hub and its affiliates permission to share it with other Users or use it in other ways in accordance with the Privacy Policy.
5.4 Each User affirms, guarantees, and agrees that (a) you are solely responsible for any User Content you submit, post or display and (b) any User Content that you submit, post, or display does not violate any third party's copyright, patent, trademark, trade name, trade secret, or other personal or property rights.
5.5 Each User affirms, guarantees, and agrees that the User Content they submit, publish, or display will: a) be true, correct, comprehensive, and legal.; b) not to be untrue, incorrect, or misleading; b) not violate the Terms or any applicable Additional Agreements c) not violate any applicable laws and regulations and c) not contain any link directly or indirectly to any other websites which includes any content that may violate the Terms.
5.6 Each User affirms, guarantees, and agrees that you shall/are: a) observe all applicable laws and regulations while you conduct your activity on the websites.; b) conduct technology transfer with other users of the Site in respectful manner; c) keep your actions within the bounds of the Terms and any applicable Supplementary Agreements.; d) do not use the Services or Site to deceive any person or entity ; e) not to misrepresent yourself or your association with any person or entity, impersonate anyone or anything; f) not engage in spamming or phishing; g) not participate in any other illegal acts, nor aid and abet any illegal activities; h) not attempt to duplicate, exploit, copy, or steal any of the material, databases, or listings included in the DOST Technology Hub; i) not entail any attempt to compromise the security of the data, systems, or networks used by DOST Technology Hub and/or any user of the Site or gain unauthorized access to those systems, data, or networks; and j) not take part in any actions that would expose DOST Technology Hub or its affiliates to responsibility.
5.7 Users not allowed to use the websites, services, or user accounts to carry out DOST Technology Hub-compatible activities.
5.8 Users consent to give DOST Technology Hub any and all information, documents, and approvals required for the provision of the Services, for determining whether the User has violated the Terms, and/or for resolving any complaints made against the User. The DOST Technology Hub shall not be required to extend the applicable service period or be liable for any loss or damages arising out of or in connection with such delay, suspension, or termination if User's failure to do so results in the provision of any Service being delayed, suspended, or terminated.
5.9 User understands and accepts that DOST Technology Hub reserves the right to, but shall not be obligated to, actively monitor or exert any editorial control over the content of any message or material or information made, obtained, or available through the Services or Site. The content of any comments or other materials or information created, published, posted, displayed, or otherwise made by any User is not endorsed, verified, or in any other way certified by DOST Technology Hub. Each User is solely responsible for the information contained in their communications and could face legal repercussions for the information contained in their comments or other materials or information.
5.10 The User acknowledges and accepts that adoptors and their representatives may only use the Site and Services; individual consumers or personal use are not permitted.
5.11 User understands and accepts that each User is solely responsible for adhering to all laws and regulations that are relevant to the use of the Site and Services in their respective locations.
6. Breaches by User
6.1 DOST Technology Hub maintains the right, in its sole discretion, to delete, alter, or reject any User Content that you submit, post, or display on the Site and that, in our reasonable judgment, violates the terms of this policy (i) breaches all applicable rules and laws, (ii) breached the terms of this agreement, (iii) potentially make DOST Technology Hub or our affiliates liable, (iv)violates any rights of a third party, (v) could be harmful to our users', third parties', DOST Technology Hub's, or our affiliates' interests, or (vi) is otherwise deemed inappropriate at the sole discretion of DOST Technology Hub.
6.2 In the event that a User violates any of the Terms or if DOST Technology Hub has good reason to think that a User has violated any of the Terms, DOST Technology Hub shall have the right to take any necessary disciplinary action, including but not limited to: (i) suspending or terminating the User’s account and any and all accounts determined to be related to such account by DOST Technology Hub in its sole discretion without liability for damages arising out of or in connection with such suspension or termination; (ii) restricting, suspending, or terminating an account's access to any Service, as well as its use in the present or the future; (iii)eliminating any product listings or other user content that the member has submitted, posted, or displayed, or limiting the amount of product listings or other user content that the user may submit, post, or display; (iv) restricting the User's usage of any features or functions of any Service in any other ways that DOST Technology Hub deems reasonable in its sole discretion; and (v) any other corrective measures and sanctions that the DOST Technology Hub deems necessary or appropriate in its sole discretion
6.3 Without limiting the generality of the Terms' provisions, a User shall be deemed to have violated the Terms if DOST Technology Hub has a reasonable expectation that any information provided by the User is not current or complete or is false, inaccurate, or misleading, and the User's actions may expose DOST Technology Hub, our affiliates, or any other Users to legal liability.
6.4 If DOST Technology Hub receives notice that the User is in violation of any agreement or undertaking with any affiliate of DOST Technology Hub, including without limitation, and such violation involves or is logically suspected to involve dishonest or fraudulent activities, DOST Technology Hub may, at any time and in our reasonable discretion, impose restrictions on, suspend, or terminate the User's use of any Service or the Site without being liable to the User. The DOST Technology Hub reserves the right to investigate any such breach and to ask the User for confirmation, although it is not compelled to do so.
6.5 The DOST Technology Hub is not responsible for, and will not be liable to you or anyone else for, any User Content or other material transmitted through the Site or Services, including fraudulent, false, misleading, accurate, defamatory, or otherwise prohibited material. Each User further acknowledges that the risk of harm from such User Content or other material is completely unfair. according to the User. The DOST Technology Hub maintains the right to assume sole control and responsibility for the defense of any matter that would otherwise be subject to indemnification by the User. In such a case, the User shall assist the DOST Technology Hub in establishing any applicable defenses.
7. Transactions Between Adoptors and DOST Agencies Technology Transfer team
7.1 DOST Technology Hub offers electronic web-based platforms via the Site via which Adopter, DOST Agencies, and Generators of services can exchange information. In addition, under the rules of the Transaction Services Agreement, DOST Technology Hub offers Users electronic web-based transaction platforms to place, accept, terminate, and complete technology transfer for the provision of technologies and services online within the Site. However, for any Services, the DOST Technology Hub does not operate as an agent for either the Adopters or the DOST Agencies Technology Transfer team in particular transactions. The DOST Technology Hub has no control over, and is not accountable for, the efficacy, legality, or accessibility of the technology transfer on the Site, the capacity of the DOST agency to carry out the technology transfer, or the capacity of the adoptor to carry out the technology transfer.
7.2 Users are hereby informed of the possible risks associated with engaging with somebody posing as someone else. The DOST Technology Hub employs a variety of techniques to confirm the veracity of certain data that users provide to us when they register for user access on the website. However, DOST Technology Hub cannot and does not check each User's alleged identity because it is challenging to verify users online.We advise you to assess whom you are dealing with by using a variety of techniques as well as common sense.
7.3 Adoptor and DOST Agency shall accept all risks associated with accessing or using the Site or Services and with performing any transactions in conjunction with or through the Site or Services. Adoptor and DOST Agency shall additionally completely and alone bear all risks of responsibility or injury of any kind arising out of or in connection with any subsequent activity pertaining to the Technology transfer or services that are the subject of the transactions on the Site.
7.4 The terms and conditions of any transactions made on, through, or as a result of using the Site or Services are set forth and must be adhered to solely by Adoptor and DOST agency on the Site.
7.5 In connection with transactions made on, via, or as a result of use of the Site or Services, User agrees to submit all information and materials that DOST Technology Hub may reasonably need. The DOST Technology Hub reserves the right to suspend or terminate any User account if the User fails to submit the required documents and information, and shall not be liable for any damages resulting from, related to, or arising out of such suspension or termination.
8. Limitation of Liability
8.1 The DOST Technology Hub shall not be liable for the correctness, completeness and up-to dateness of the contents given by the user. The User may utilize the contents that can be retrieved at their own risk. The opinions expressed in contributions attributed to specific individuals are those of the individual authors and do not necessarily reflect those of the provider.
8.2 Links to third-party websites can be found on DOST Technology Hub. The respective owners of these websites are in charge of them. The DOST Technology Hub checked the contents of the external links during initial connection to ensure that there were no legal infractions. At that time, no infractions of applicable laws were evident. The present and future layout and content of the connected sites are completely independent of the DOST Technology Hub. The DOST Technology Hub does not claim ownership of the material related to any external links or references, despite their inclusion. Continuous monitoring of potential infractions of applicable legislation is not thought to be appropriate in the absence of conclusive evidence of infringement. External links of that nature, however, will be immediately removed if such violations are discovered.
8.3 Services offered by independent third parties may be made available to Users through the Site. Regarding these services or the transfer of technology, no warranty or representation is offered. Any such services or technology transfer are not subject to DOST Technology Hub or our affiliates' liability.
8.4 DOST Technology Hub shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or other damages whatsoever , or any other damages deriving from any of the following: a) the use or the inability to use the Site or services; b) any defect in data, information or services or obtained from a User or any other third party through the Site or Service; c) claims or demands that the use of technology transfer or services made available, exhibited, or shown through the Service may violate or be claimed to violate Third Party Rights; d) Unauthorized third party access to any User's data or private information; e) statements or conduct of any User of the Site or Service; or; f) any issues with the Site or Services, regardless of how they occur, including negligence.
9. Force Majeure
9.1 DOST Technology Hub is not responsible for loss or discomfort or failure of service or system due to the following reasons: (i) system closure for maintenance; (ii) inability to transmit data due to failures in communications terminals or telecommunications equipment; (iii) systems failure and inability to perform its functions; (iv) suspension or delay of services or systems failure due to reasons beyond the reasonable control of DOST Technology Hub.
10. Intellectual Property Rights
10.1 All of the rights and interests in the website and its contents are solely owned by DOST Technology Hub or are legally licensed to it. Trade secrets and other intellectual property rights are contained in the website and its content, which are protected by copyright and other laws. The DOST Technology Hub, its affiliates, or our licensors, as applicable, shall retain all title, ownership, and intellectual property rights in the Site and the Site Content. The DOST Technology Hub hereby reserves all rights not expressly granted in the Terms or by DOST Technology Hub.
10.2 Department of Science and Technology's registered trademarks include "TecHub," "DOST Technology Hub," and associated icons and logos. Related symbols and logos are also registered trademarks or service marks of DOST Technology Hub and its affiliates.they are protected by the relevant copyright, trademark, and other property rights laws in many places. It's against the law to use, publish, or modify these trademarks in any way without the owner's permission.
10.3 In order to provide the DOST Technology Hub Site or Service, independent third parties may be involved. Without the independent third parties' prior written consent, you are not permitted to use any of their trademarks, service marks, or logos.
10.4 To the fullest extent permitted by applicable law, DOST Technology Hub and/or its affiliates shall own all rights, title, and interest in and to all derivative works made using User Content in accordance with the Terms, which may be freely assigned, licensed, or granted by DOST Technology Hub to any third party or its affiliates.
11. Notices
11.1 All legal notices or demands to or upon DOST Technology Hub shall be made in writing and sent to DOST Technology Hub personally, by courier or certified mail to the following entity and address: Department of Science and Technology, DOST Compound, Gen. Santos Avenue, Bicutan, Taguig City .
11.2 Any legal notices or demands made to or upon a User shall be valid if personally delivered, sent through courier to the email address the User has provided to DOST Technology Hub, or posted on a publicly accessible page of the Site. An individual user is deemed to have gotten notice if and when:
DOST Technology Hub is able to demonstrate such communication, whether in physical or electronic form, has been sent to such User, or immediately upon DOST Technology Hub posting such notification on an area of the Site that is publicly accessible.
11.3 You acknowledge and agree that DOST Technology Hub may communicate with you electronically to the extent necessary to comply with legal requirements requiring notice or other forms of written communication.
12. General Provisions
12.1 The Terms replace any earlier written or oral agreements pertaining to the same subject matter herein and, subject to any Additional Agreements, represent the complete understanding between you and DOST Technology Hub with regard to and govern your use of the Site and Services.
12.2 If any clause in the Terms is determined to be invalid or unenforceable, the remaining clauses will continue to be legal and enforceable.
12.3 Any rights that DOST Technology Hub fails to enforce or any actions it takes in response to a breach by you under the Terms do not constitute a waiver of those rights or of DOST Technology Hub's ability to take action in response to subsequent or similar breaches.
12.4 YOU AGREE THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND DOST TECHNOLOGY HUB, AND YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. WHATEVER PROPOSAL OR PRIOR AGREEMENT, WHETHER ORAL OR IN WRITING, AND ANY OTHER COMMUNICATION BETWEEN YOU AND DOST TECHNOLOGY HUB RELATING TO THE SUBJECT OF THIS AGREEMENT, ARE HEREBY REJECTED.
